STANDARD SUBSCRIPTION TERMS AND CONDITIONS OF USE FOR BETACARE NG

Introduction

Betacare NG is an online healthcare platform designed to enhance awareness and understanding of healthcare services, serving as an intermediary connecting users (referred to as the "User") and health practitioners in Nigeria. It offers an array of healthcare topics, facilitates communication with registered medical practitioners, and provides access to various healthcare services in the country.

Betacare NG Services ("Betacare NG Services") include:

  • Text Consultation: Enables private and confidential one-on-one health discussions via text messages with a doctor.
  • Phone Consultation: Provides 24/7 direct access to a doctor via phone, allowing users to request a consultation with the next available health practitioner.
  • Health Tips: Delivers health-related information vetted and localised by doctors through SMS or notifications on the Betacare NG App.
  • Symptom Checker: Assists users in identifying potential health conditions based on experienced symptoms.

Please note that these services may be updated, modified, or expanded periodically, not limited to those mentioned above.

Purpose of Services:

The Betacare NG Services are not intended to replace professional medical advice, consultation, diagnosis, or treatment. All information obtained through Betacare NG is for informational and educational purposes only.

Subscription to BetaCare NG Services

Access to BetaCare NG's services varies based on the method of subscription, which includes:

  1. BetaCare NG Website
  2. BetaCare NG Voucher
  3. Third-Party Benefit Programme (Refer to the BetaCare NG Partner Page on the website)
  4. BetaCare NG Call Centre
  5. Airtime Recharge via your phone network (E.g., Glo, MTN, etc.)

Users can only access services for which they have subscribed and paid.

All subscriptions are subject to approval by BetaCare NG. We reserve the right to accept or reject service offers made by Users and may take measures to restrict or suspend services for Users who misuse the platform.

Subscription Process:

All subscriptions are subject to approval by Betacare NG. Betacare NG reserves the right to accept or reject service offers from users and may take action to limit or suspend services for users who misuse the platform.

Free Trial Period:

For users subscribing to Betacare NG Services (excluding those from third-party benefit programs), a 1-day free trial period is provided.

Selected Betacare NG Services:

The availability and pricing of selected services are determined based on the subscription channel used or the specific service subscribed to. Special promotions or vouchers may be subject to additional conditions, including availability and limited-offer terms.

User's Representations and Warranties:

By subscribing to the services, users represent that they have read and understood the terms and additional conditions, are of legal age (18 or older), understand the financial commitments, are in a position to meet obligations, and are authorized to use the payment method provided.

Users also guarantee that all information shared with health practitioners during service usage is entirely truthful and accurate, acknowledging the serious consequences of providing false information.

Payment & Payment Methods

All payments for BetaCare NG services must be made on a pre-paid basis, requiring subscription fees to be paid in advance before utilizing the selected services.

If the User prefers extended payment methods (such as debit order, credit card, or airtime billing), these payments will operate on a continual commitment basis. This commitment extends throughout the subscription period via monthly debit orders, recurring credit card payments, airtime billing, or other recurring payment options offered by BetaCare NG.

By choosing a payment method, the User authorizes and instructs the designated entity as their agent to facilitate payment and remains responsible for completing payments to BetaCare NG, assuming the associated risks.

For debit orders or similar electronic payments, BetaCare NG and its affiliates are authorized to debit the User's bank account between the 1st and last day of each month for any fees, costs, charges, and taxes owed according to the Agreement.

In the case of airtime billing or similar electronic payments, BetaCare NG is authorized to deduct the due amounts from the User's airtime between the 1st and last day of each month.

Suspension and Cancellation

The User's entitlement to BetaCare NG services is contingent on timely payments to BetaCare NG.

Both BetaCare NG and the User reserve the right to cancel the Agreement, without stating a reason, by giving a 30-day notice through online cancellation on the BetaCare NG website or app.

For Third-Party Benefit Programmes, Users can access Hello Doctor Services under the condition that the agreement between the Third Party Benefit Programme and BetaCare NG remains legally valid and that the Third Party Benefit Programme has paid for the service.

BetaCare NG has the right, though not an obligation, to:

  1. Suspend services due to events beyond its control preventing service performance.
  2. Suspend, cancel, or terminate the Agreement in cases of delayed or non-payment by the User or Third Party Benefit Programme.
  3. Terminate the Agreement if the agreement between BetaCare NG and a Third Party Benefit Programme is suspended, terminated, or expires.

Disclaimer Regarding Services:

Betacare NG makes no express or implied warranties about the services provided. There is no guarantee of continuous access or uninterrupted service, quality of reception, error-free software, or the absence of interruptions. Services are provided on an "as is" and"as available" basis.

Betacare NG shall not be liable for the content of materials constituting the selected service, whether provided by Betacare NG or a third party, unless in cases of gross negligence or willful misconduct.

Personal Information

For BetaCare NG services in Nigeria, the User explicitly provides and is considered to have given express permission for the collection, processing, storage, and distribution of their personal information as required for the service.

In compliance with applicable laws, the User commits to:

  1. Supply BetaCare NG with necessary personal and contact details to facilitate service administration and delivery.
  2. Notify BetaCare NG or the Third Party Benefit Programme, if applicable, within 7 days of any changes in the information provided in connection with the BetaCare NG service.

The User grants authorization to BetaCare NG, not obligatory, subject to relevant laws, to:

  1. Access the User's financial risk and payment habits ("Payment Profile") from a Credit Bureau for fraud prevention and debtor tracing, and share the Payment Profile information with the Credit Bureau.
  2. Utilize the User's information for various purposes such as processing requests, administering the Agreement, communicating new service features, promoting competitions, and disclosing personal information (excluding private medical details).

This authorization includes sharing the User's information:

  1. With BetaCare affiliates for marketing their services.
  2. With any entity acquiring BetaCare NG or its parts.
  3. With appointed agents, representatives, or service providers for transaction processing, Agreement administration, and management services.
  4. With payment system providers for fee collection through third-party payment systems.
  5. To retain the User's personal information as required by law or to safeguard rights under this Agreement.

BetaCare NG's Failure to Perform

BetaCare NG will not be held liable for its failure to perform if such failure is due (wholly, partially, or belatedly) to an unforeseen event or circumstance beyond its reasonable control, preventing timely or proper service delivery. This includes technical issues or downtime related to fixed-line or mobile telecommunication providers, which, in each instance, are beyond BetaCare NG's control. This is even after exercising reasonable care and diligence to prevent or mitigate the occurrence or consequences of such events or circumstances.

Limitation of Liability

BetaCareNG and the attending doctor shall not be held liable for any direct damages beyond the subscription price of any service subscribed or paid for. Furthermore, to the maximum extent permitted by law, they will not be liable for any special, punitive, indirect, incidental, or consequential damages. These damages include but are not limited to personal injury, wrongful death, or loss of use, whether in any action in warranty, contract, or otherwise connected with the use of, or the inability to use, these services.

Indemnity

You indemnify, defend, and hold harmless BetaCareNG and the attending doctor, as well as their affiliates, from and against all losses, liability, expenses, damages, and costs, including attorney's fees. This includes those arising out of or related to any breach of the terms of use, your relationship with BetaCareNG and the attending doctor, any negligent or wrongful action or omission by you related to your use of services through BetaCareNG, or any negligent or wrongful use of the services, including negligent or wrongful conduct by you or any other person acting on your behalf.

Waiver

BetaCareNG shall not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with the use of or reliance on any information or services available on or through BetaCareNG, and all those associated or affiliated with it, including the attending doctors. Consequently, in consideration for the services provided, you, the User requesting the call back, hereby waive your or your family member's (including, but not limited to, your and your minor child's estate and/or any beneficiary thereunder) right to bring any normal, reasonable, or legally enforceable claim, action, proceeding, application, or demand against BetaCareNG and all those associated or affiliated with it, including the attending doctors, for any claims, costs, damages, expenses, or otherwise arising out of or suffered by you and/or your family member as a result or consequence of making use of these services or otherwise.

Acceptance of BetaCareNG's Terms & Conditions

By subscribing to the BetaCareNG Services, you will be considered to have read, understood, and agreed to both these Terms and Conditions of Use and the Standard Subscription Terms and Conditions.
